On Wednesday, Ada County Judge Steven Hippler denied their motion in his ruling.
“The Court concludes that defendants do not warrant relief on any of the motions,” Hippler wrote in his 55-page order.
Prosecutors noted that they intend to seek the death penalty if Kohbarger is convicted.
Hippler addressed the constitutionality of the death penalty in the United States, pointing to a time when the highest courts in Idaho had upheld the death penalty.
Kohbarger’s defense has long demanded that the death penalty be dropped if the 29-year-old is convicted.
His defense attorney, Jay Logsdon, had previously argued that the death penalty went against “contemporary standards of decency.”
Logsdon had previously pointed to the 24 states that allow the death penalty, arguing that support for the death penalty was “depressing”.
“In fact, less than half of the states still impose the death penalty under legislative or executive action,” they wrote.
“Taking into account the populations of those states, support for the death penalty is even bleaker.”
Kohbarger is accused of stabbing two University of Idaho students to death at a home near the college campus in Moscow in November 2022.
