Media Take Out confirms that Judge Arun Subramanian on Wednesday rejected Sean “Diddy” Combs’ team’s motion for release.
His decision came after a two-hour court hearing on Friday, in which he appeared to explore possible options and question prosecutors’ allegations that Combs was hindering the ongoing investigation.
“The Court finds that the Government has shown by clear and convincing evidence that no condition or combination of conditions will reasonably ensure the safety of the community,” the judge wrote in a five-page order.
Federal prosecutors argued that Diddy could not be trusted with bail because he had violated jail and judge rules. They said he was a danger to women and was tampering with witnesses – even while in federal custody at the Metropolitan Detention Center.
Prosecutors allege that Diddy tried to avoid law enforcement surveillance by using a variety of techniques, including three-way calling, to contact witnesses. They also accused him of violating the judge’s own order limiting communications and ignoring his lawyers’ guidance by running a social media campaign around his birthday to try to influence the potential jury pool.
In his decision the judge pointed to evidence that Diddy was not following prison rules – including his continued use of the messaging service. “Underscoring the Court’s concern, despite assurances given to the Court by defense counsel at the November 22, 2024 hearing (in Combs’ presence), that Combs has ceased using ContactMeASAP effective November 16, 2024, …The government indicates that Combs continued to use this service as recently as last Sunday, November 24, 2024.”
His attorneys have consistently attempted to obtain his release from federal custody, arguing that private security would provide greater restrictions on Combs than federal prison. He said Combs needs to be free to help prepare his defense against criminal charges and about 30 civil lawsuits alleging sexual abuse.
