A New Mexico judge Upheld its decision to dismiss one count of involuntary manslaughter. Charges against Alec Baldwin in the fatal shooting of a cinematographer on the set of a Western film.
In a ruling Thursday, state District Court Judge Mary Marlo Sommer stood by her July decision to dismiss a charge of culpable homicide Against Baldwin.
He said prosecutors made no factual or legal arguments that could justify overturning their verdict.
The judge wrote, “Because the State’s amended motion raises arguments already made, and raises arguments the State previously chose not to raise, the Court does not find the amended motion in good standing.” He also said that the request was also untimely.
A spokesman for Baldwin’s lawyers said Friday they had no immediate comment on the ruling.
Special prosecutor Kari Morrissey told The Associated Press that she disagrees with the court’s analysis and will appeal the decision.
Morrissey was appointed by the Santa Fe District Attorney to take over the case in March 2023 after the previous special prosecutor resigned following missteps in filing initial charges.

Marlo Sommer last month rejected a request to throw out Gutierrez-Reed’s conviction or call a new trial over allegations that prosecutors failed to share evidence that could have exonerated her.
She found that Arsenal’s lawyers did not establish that there was a reasonable probability that the outcome of the trial would have been different had the evidence been available to Gutierrez-Reid, whose appeal is still pending in the High Court.
